Advising companies and the public sector on state aid law is a growing focus of our work. State aid law often plays an important role at the intersection between the public sector and companies, and not only in classic subsidy constellations. An evaluation of state aid law and structuring in conformity with state aid law must ultimately be taken into account in all financially relevant decisions and transactions of the public sector. Whether grants are to be distributed, loans granted or either public or public-private companies financed; EU state aid law must always be complied with in these projects. We advise both the public sector on structuring and if necessary on notification in compliance with state aid law, as well as private companies with regard to the challenges of publicly financed projects or reclaims.
